Westlands Water District Policy for Unclaimed Monies (#656)

At the October 19, 2021 Board of Directors meeting, the Board approved the Westlands Water District Policy for Unclaimed Monies (Policy). The Policy is in accordance with Government Code Section 50050 through 50057, which allows a local government agency to adopt a policy and procedure to process unclaimed funds. The District’s Policy includes a provision for posting the list of unclaimed monies to the District’s website and to the web users login site, making the information available to water users and landowners.

The list of unclaimed monies, as well as the Policy, is now available on the District’s website, under the Notices menu option, and on the web user login site. The list will be updated periodically, as prescribed by the Policy.

The listing of unclaimed monies will be available on the District’s website and on the web users login site for sixty (60) days to give water users and landowners an opportunity to review and make a claim. After the sixty (60) day review period, the District, in accordance with Government Code 50050 through 50057, will proceed to a public noticing period.

Unclaimed monies that remain unclaimed shall become the property of the District forty-five (45) days after an initial public notice is published. The public notice will be published once a week for two successive weeks in a newspaper of general circulation within the District’s jurisdiction. The public notice shall include the name of the individual or business as shown on the check issued, the check number and the dollar amount of the check. Any individual item of less than fifteen dollars ($15), which remains unclaimed for a period of one (1) year, may be transferred to the District without the necessity of publishing a notice in a newspaper.

If you wish to make a claim, you must file a claim and supporting documentation with the District during the review period or before the date the unclaimed monies become property of the District. The District’s Unclaimed Monies Claim Form is listed in the Policy in Exhibit 3 – Unclaimed Monies Claim Form.

The District may release to the claimant unclaimed monies if claimed prior to the date the money becomes property of the District upon submitting proof satisfactory to the Treasurer.
